Lawyer Says Habeas Corpus Must Come First as Abu Trica’s Detention Is Questioned

A legal representative for former Ghana international footballer Abu Trica has called on authorities to uphold constitutional protections following his continued detention, emphasising that the right to habeas corpus must be respected.

In a statement released this week, the lawyer highlighted that every person — regardless of public profile or allegations against them — is guaranteed the right to challenge the legality of their detention in court. Habeas corpus, he explained, is a fundamental principle of Ghana’s Constitution that prevents unlawful or indefinite imprisonment without judicial review.

The comments come amid discussions around Trica’s ongoing detention after reports suggested he was held in connection with matters related to his club and football activities. Although some details of the case remain confidential, the lawyer stressed that procedural fairness and legal accountability must take priority.

“Habeas corpus comes first,” the lawyer said, explaining that the legal system must ensure Trica is brought before a court without unnecessary delay so that the lawfulness of his detention can be examined. He added that this right exists to protect individuals from arbitrary or unjust deprivation of liberty.

The lawyer also pointed out that public figures like Trica can sometimes find themselves at the centre of intense media and public scrutiny, but that does not exempt authorities from following due process. “When someone is detained, the law demands transparency and judicial oversight,” he said. “No one should be held without the opportunity to have their detention reviewed by an independent court.”

Legal experts and rights advocates have weighed in on the matter, saying habeas corpus is a cornerstone of justice and safeguards against abuse of power. They noted that when a person’s liberty is at stake, courts must act swiftly to ensure that legal procedures have been followed and that individual rights are upheld.

As debate continues about the circumstances surrounding Trica’s detention, the lawyer reiterated his commitment to defending his client’s constitutional rights. He said that if any step in the detention process has disregarded legal safeguards, those issues will be raised vigorously in court.

The situation has sparked significant public interest, with fans and legal observers closely watching how the authorities and judiciary respond in the coming days.
